Absentee Ballot Research

Help research state law for our nonprofit voter assistance resource series

Posted April 12, 2023

Background & Context

We’re in the middle of creating a resource series for grassroots nonprofit organizations working on democracy-enhancing civic engagement and civil rights projects at the state level.

The grassroots groups we serve do amazing work on the ground, but are often quite small and don’t necessarily have access to affordable experienced counsel. These organizations would often like to help constituents exercise their right to vote, including voting absentee when appropriate. Many states have complicated rules about absentee voting, however, and an organization that violates those rules, even unintentionally, may face fines or worse.

Our voter assistance series is designed to help organizations understand the risks and regulatory burdens presented by different activities, and design programming they can execute safely and effectively.

Work & Deliverables

We will provide instructions and a data input form and you’ll be asked to research various elements of the state absentee voting rules, including whether organizations can:
- Help voters request an absentee ballot
- Collect and return applications for absentee ballots
- Pay for postage to return an absentee ballot application
- Help voters fill out their actual absentee ballot

NO SPECIFIC PRACTICE AREA EXPERIENCE REQUIRED
Although if you have experience with voting or election law, we’d love to benefit!

Project Plan

Preparation Phase

  • Once you express your interest in this project we'll send you a link to select a state.
  • If you see a state you'd like to work on you can then sign up for that state.
  • We'll confirm your state, and send you detailed instructions for inputting your research.
  • We'll also send you a sample finished resource, so you can see how your work fits in.

Collaboration Phase

  • We're available to answer questions if you have them as you do your work.

Wrap Up

  • We ask that you aim to finish the research within three weeks of checking out a state.
  • If you like the work you can ask for another state once you've turned in your first state!
