Training: Representing Telehealth Abortion Providers

Background & Context

Join We The Action, the National Association of Women Lawyers, and the Reproductive Health Initiative for Telehealth Equity & Solutions (RHITES) for a virtual training session designed for healthcare regulatory and corporate attorneys. This webinar will explore the complexities of analyzing litigation, evolving laws, and changing regulations to help attorneys effectively advise clients.

The session is ideal for healthcare regulatory and corporate attorneys interested in providing pro bono support to healthcare providers who currently offer—or are interested in offering—abortion and other reproductive healthcare services via telehealth across the United States.

Immediate Problem

With increasing threats to telehealth for abortion care, now is the time to understand the complexities of analyzing litigation, evolving laws, and changing regulations in order to effectively advise clients. Since the Dobbs decision, navigating the overlapping state and federal laws governing telehealth, mail-order pharmacy dispensing, and cross-state licensure has become increasingly challenging for reproductive health innovators.

This session will examine both new and existing litigation, laws, and regulations affecting different telehealth care models and explore how they can be integrated into abortion and broader reproductive healthcare delivery. RHITES will also demonstrate how attorneys can approach legal reviews with a "get to yes" mindset, balancing legal compliance with clients' risk tolerance to provide practical, solution-oriented advice.

Work & Deliverables

This session will examine litigation, laws, and regulatory frameworks governing telehealth modalities and their integration into abortion care. RHITES will also discuss the broader implications for abortion access and provide attorneys with a practical framework for navigating provider and patient risk, healthcare regulations, and compliance considerations.

Attendees will leave with a stronger understanding of the state laws governing telehealth abortion care, access to resources for addressing future legal questions, and opportunities to become more involved in supporting the provision of abortion care via telehealth.

Attorneys interested in volunteering will have the opportunity to join a network of qualified legal professionals available to support telehealth platforms, clinical providers, technology vendors, and funders working to expand equitable access to abortion care.

This webinar is intended primarily for healthcare regulatory and corporate attorneys interested in providing pro bono legal support to abortion providers navigating the evolving telehealth landscape.

Speakers:

Dana Northcraft, JD (she/her)
Dana Northcraft is the Founding Director of RHITES (Reproductive Health Initiative for Telehealth Equity & Solutions), the only organization that sits at the intersection of the telehealth industry and the sexual and reproductive health, rights, and justice organizations to inform, educate, and empower these entities to embrace and expand telehealth for abortion care. She co-leads the Telehealth for Medication Abortion Care Working Group and is a Society for Family Planning Affiliate Fellow where she serves as co-chair of the Telehealth Practitioners Special Interest Group.

Natalie Birnbaum, JD (she/her)
Natalie Birnbaum is a healthcare attorney and policy expert shaping the future of telehealth for medication abortion. As the State Legal and Policy Director at RHITES, her portfolio focuses on state policies impacting and advancing equitable access to abortion care via telehealth. As the founder of the boutique law firm Repro Solutions PC, she advises telehealth providers and platforms nationwide and has successfully advocated for the passage of Shield Laws in New York and California.
