Employment Status Compliance: Contractors vs Employees

Ensure compliance with employment laws and regulations

Posted August 9, 2024

Background & Context

A Foundation Building Strength is a small nonprofit that has operated with a lean team consisting of part time contractors for the past 15 years. As the organization begins to grow, the need to a more dedicated staff is evolving but we don't have the resources to determine if we are legally compliant with contractors or if we need to shift to employees. We need help to assess these roles and provide guidance on if and how to convert contractors to employees.

Work & Deliverables

Our nonprofit currently has one employee and 4 independent contractors. We want to assess and ensure we are legally compliant and determine if any of all of the contractors need to be converted to employees.

A Foundation Building Strength for Nemaline Myopathy (AFBS)

Our mission is to find treatments for Nemaline Myopathy, a rare muscle disease affecting all skeletal muscles. AFBS works to address issues for our NM families from all angles, including advancing research, providing information about care, offering family support groups and ways to connect, and creating opportunities for in-person interaction and education at conferences.
