Combat Pro-Gun Litigation in Lower Courts

Track and flag 2A cases in lower courts for intervention.

Background & Context

The landmark decision in NYSRPA v. Bruen in late June impacted all ongoing 2A cases in lower courts and likely incentivized new litigation efforts from pro-gun organizations. In order to proactively combat pro-gun litigation in the judicial system, which is increasingly skewed towards conservative interests, we must monitor 2A cases and identify particularly important ones to intervene in.

Work & Deliverables

Lawyers will need to identify and track new and ongoing 2A/gun law cases in lower courts, including district and appellate courts, as well as state Supreme courts. We will also provide names of specific cases for close monitoring, including Wade v. Michigan (Michigan Supreme Court) and NRA v. Swearingen (Eleventh Circuit). Lawyers are encouraged to flag cases that involve our mission and appear particularly compelling for closer review and potential intervention by the organization.

Preparation Phase

  • Intro call with Judicial Advocacy Team
  • Fill out relevant volunteer paperwork

Collaboration Phase

  • Get to know organization's mission
  • Spend 1-3 hours on project every week for 1 month
  • Deliver weekly report on cases
  • Deliver immediate report on new developments in cases flagged by organization

Wrap Up

  • Deliver final report and any recommendations on next step organization should take in litigation
  • Confer with Judicial Advocacy Team to wrap up loose ends

March For Our Lives

Born out of a tragic school shooting, March For Our Lives is a courageous youth-led movement dedicated to promoting civic engagement, education, and direct action by youth to eliminate the epidemic of gun violence. We aim to create safe and healthy communities and livelihoods where gun violence is obsolete. Recognizing the importance of the courts in gun violence prevention, the Judicial Advocacy Team was created to further MFOL's mission through legal channels. In everything from our amicus briefs to our active litigation, we amplify the stories of young people affected by gun violence. We aim to demonstrate to the judicial system how its decisions have a real impact on lives in the present.
