Appeal a Federal Award Termination

Help improve health and social needs access for the LGBTQ community

Background & Context

Our organization received a termination letter from the NIH for our award that was supposed to run through September 2025 with expectation of renewal each year for an additional 3 years and up to 8 more years. This represented a loss of millions of dollars to the organization and puts us in a full crisis/emergency situation as the sudden loss of funding means salary cuts and layoffs. The award focused on the LGBTQ+ community and improving health outcomes. Without funding we cannot continue the research and implementation of improved health and social services for the LGBTQ+ community nor manage the initiative that was bringing 40+ partners together in support of the community during these challenging times.

As a smaller nonprofit, we don't have the resources for any legal representation. We feel we can and should appeal this decision but we are unsure how to proceed.

Immediate Problem

An appeal would need to be filed by 3/27/2025 so it is very time sensitive.

Work & Deliverables

Support our organization in the appeals process of an NIH award termination:

-Review Terms and Agreements for award from NIH
-Review termination letters and documents
-Research to determine if this falls under any current lawsuits
-Research strategy that may be effective in current federal context
-Draft an appeal to the termination by 3/27/2025
-If needed, provide legal advising in response to the results of the appeal
-Provide advisement on how to protect organization's status in current climate.
